Domestic royalty rate survey results

Today, we introduce the 2009 Japan Patent Office (JPO)’s Investigation and Research Report on the Industrial Property Rights System, “Survey and Research on how to utilize patents, etc. based on the value evaluation of intellectual property. Understanding the actual conditions of intellectual property (asset) values and royalty rates.”

The royalty rate generally refers to the ratio of the profit on the sales, etc. of the consideration paid by the user to the owner of an intangible asset when the license of the intangible asset is granted, such as a patent right, know-how, etc.

This report summarizes the results of the TEIKOKU DATABANK LTD’s survey focusing on the valuation of intellectual property and the royalty rate with the commission of the JPO. The royalty exemption method is one of the typical valuation methods for intellectual property licensing, buying and selling, and M & A. However, because it was difficult to set the royalty rate used for value calculation, there was strong needs for information about royalty rate by each industry and sector. This report meets these needs.

Domestic questionnaire surveys were conducted on 3,006 domestic companies and organizations, and royalty rates by technology category (or by product category) were collected for patent rights, trademark rights, program copyrights, and technology know-how to obtain average values. In addition to the royalty rate, the results of questionnaire surveys are also summarized for the period of the technology life cycle by technology category, the importance of the factors that determine the royalty rate, and the factors that affect the royalty rate.

This report was published in March 2010 and August 2010.

The material published in March 2010 is divided into two parts, the main section and the material section, and the material section is further divided into the material section I-II and material section III.
The contenst are:

・ Royalty rates in foreign countries
・ Disclosure of royalty information
・ Challenges and Proposals in the Future
Of these, the “Royalty rates in Japan” and the corresponding material section serve as meeting the needs for the royalty exemption method.

The report published in August 2010 is a re-analysis of royalty rate information on patent rights based on new technology categories such as biotechnology. No new results of questionnaire or data are added to the report. However, the results of a new analysis in a technical field different from the technical classification in the previous report are included in the report.

These reports are a summary of licensing-out data for Japanese companies and organizations. Therefore, it is certainly a useful collection of data when dealing with royalty rates for domestic projects.
